1. Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by Websta OÜ, a private limited company registered in Estonia (together, the “Services”). By creating an account, publishing a profile, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree with these Terms, you must not use the Services.
2. Eligibility
You must be at least 18 years old and have full legal capacity to enter into a binding contract in your country of residence. By using the Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of a company, you represent that you are authorised to bind that company to these Terms.
3. Account registration
To use most features of the Services you must create an account. You agree to:
- Provide accurate, current, and complete information when registering.
- Keep your login credentials confidential and secure.
- Notify us promptly at dpo@websta.ai if you suspect unauthorised access to your account.
- Be responsible for all activity that occurs under your account.
We may refuse registration, suspend, or terminate accounts that contain false information or that we reasonably believe are being used in violation of these Terms.
4. Providers
If you publish a profile and offer services through Websta (a “Provider”), you acknowledge that:
- You are solely responsible for the services you offer, including their quality, safety, legality, and accuracy of description.
- You must comply with all applicable laws and regulations in the countries where you operate, including licensing, health and safety, consumer protection, and tax laws.
- You are responsible for declaring and paying any taxes on income earned through the Services. Websta does not act as your employer.
- You will not publish misleading claims, fake reviews, or content that infringes the rights of third parties.
- You will honour confirmed bookings or, if you need to cancel, do so in good faith and with reasonable notice.
5. Clients
If you use Websta to discover and book services from a Provider (a “Client”), you agree to:
- Provide accurate information when making a booking request.
- Pay the agreed price for services you have booked and received.
- Respect the Provider's cancellation policy and time.
- Treat Providers respectfully and lawfully.
The contract for any booked service is between the Client and the Provider. Websta is not a party to that contract and does not deliver the underlying service.
6. Content and intellectual property
You retain all rights to the content you upload to Websta (“Your Content”). By uploading content you grant Websta a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, adapt, and distribute Your Content solely for the purpose of operating, promoting, and improving the Services. This licence ends when you delete Your Content, except where we are legally required to retain copies or where Your Content has been shared with other users who retain their own copies.
You must not upload content that infringes third-party intellectual property rights, contains malware, or violates applicable law. We may remove content that we believe violates these Terms, at our sole discretion.
All rights in the Websta platform itself — including the source code, design, trademarks, and branding — are and remain the exclusive property of Websta OÜ.
7. Prohibited uses
You must not use the Services to:
- Commit fraud, money laundering, or any other unlawful activity.
- Send spam, unsolicited marketing, or phishing communications.
- Offer services that are illegal, sexually exploitative, or that harm minors.
- Discriminate against Clients or Providers on the basis of protected characteristics.
- Impersonate any person or entity, or misrepresent your affiliation with anyone.
- Circumvent, disable, or interfere with security features of the Services.
- Scrape, crawl, or extract data from the Services in bulk without our written permission.
- Reverse engineer, decompile, or create derivative works of the platform code.
8. Payments and fees
Publishing a profile on a websta.bio subdomain is always free. Optional paid features currently include:
- Custom domains — connect your own domain for €0.69 per month, billed via Stripe.
- Additional sites and credits — the first two sites are free; additional sites require Websta credits, which can be purchased through the account area.
- Premium AI features — usage-based fees may apply and will always be shown to you before you confirm.
All payments are processed by Stripe. By paying, you also agree to Stripe's terms. Fees are charged in euros unless otherwise stated and include applicable VAT.
Refunds are handled in accordance with EU consumer law. If you are a consumer residing in the EU, you have a 14-day right of withdrawal for digital services, unless you have expressly requested immediate performance and acknowledged that the right of withdrawal is lost once the service has been fully performed.
9. Service availability
We strive to keep the Services available and performant, but we provide them on a “best effort” basis. We do not guarantee uninterrupted availability and we do not offer a formal uptime SLA on the free tier. We may perform scheduled maintenance, deploy updates, or temporarily suspend parts of the Services to protect platform integrity.
10. Termination
You may delete your account at any time from the account settings page. Upon deletion, your profile will be unpublished and your personal data handled in accordance with our Privacy Policy.
We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or unlawful activity, or placed Websta at legal or reputational risk. Sections that by their nature should survive termination (including intellectual property, liability limits, and governing law) will continue to apply.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Websta disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free, that defects will be corrected, or that any content or listings are accurate, complete, or reliable.
12. Limitation of liability
To the maximum extent permitted by law, Websta and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of goodwill, or loss of data, arising from your use of the Services.
Our total aggregate liability to you for any claims arising out of or relating to the Services will not exceed the greater of (a) the total fees you paid to Websta in the 12 months preceding the event giving rise to the claim, or (b) one hundred euros (€100). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or death and personal injury caused by our negligence.
13. Indemnification
You agree to indemnify and hold Websta harmless from any claim, liability, loss, or expense (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms. If you are a Provider, you specifically agree to indemnify Websta for any claim arising from the services you deliver, their quality, safety, or legality.
14. Governing law
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law principles. Exclusive jurisdiction over any disputes shall lie with the Harju County Court (Harju Maakohus) in Tallinn, subject to mandatory consumer protection rules that may grant EU consumers the right to bring proceedings in their country of residence.
15. Dispute resolution
Before filing a formal claim, we ask that you contact us at info@websta.ai and give us a reasonable opportunity to resolve the dispute informally. If the dispute cannot be resolved within 30 days, either party may refer it to the competent court. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. Changes to terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-app notice at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
